Threshmoor Terms of Service

1. Acceptance of these Terms
These Terms of Service (“Terms”) are an agreement between you and Threshmoor Advisors, Inc. (“Threshmoor,” “we,” “us”). By creating an account, accessing, or using the Threshmoor website, API, or related services (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Threshmoor aggregates and normalizes public government records (such as building permits, code-enforcement records, land development filings, business filings, and property records) and provides tools to search them, including AI-assisted lead search and optional contact enrichment. All records are drawn from public sources. Coverage varies by jurisdiction and data category, and we tell you honestly what we cover; where a field is unavailable, we return an empty value rather than a fabricated one.
3. Accounts
You must provide accurate information when creating an account and keep your credentials and API keys secure. You are responsible for activity under your account and keys. Plans may include usage limits (such as monthly request and contact-lookup limits), which we may enforce automatically.
4. Acceptable use
You agree not to: (a) use the Service for any unlawful purpose; (b) resell or redistribute raw Service data in bulk in a way that substitutes for the Service; (c) attempt to circumvent usage limits, authentication, or security; (d) use the Service to harass, stalk, or harm any person; or (e) interfere with the operation of the Service.
5. Contact data and communications compliance
The Service can, at your request, return contact information (such as names, phone numbers, emails, and mailing addresses) associated with a property (“Contact Data”). Contact Data is provided for lawful business outreach only. You are solely responsible for complying with all laws that apply to your outreach, including the Telephone Consumer Protection Act (TCPA), federal and state Do-Not-Call (DNC) rules, the CAN-SPAM Act, and any state-specific telemarketing or privacy laws. Phone numbers may be flagged “Do Not Call” or “Litigator”; you should not call flagged numbers for solicitation without proper prior consent. Threshmoor does not provide legal advice, and providing Contact Data is not a representation that any particular communication to that contact is lawful.
6. No FCRA use
Threshmoor is not a consumer reporting agency, and the Service does not provide “consumer reports” as defined by the Fair Credit Reporting Act (FCRA). You may not use the Service or any data from it, including Contact Data, to determine any person’s eligibility for credit, insurance, employment, housing/tenancy, or any other purpose covered by the FCRA.
7. Data accuracy; no warranty of results
Records come from government sources that vary in quality, freshness, and completeness, and Contact Data is compiled by third-party providers. We do not guarantee that any record or contact detail is accurate, current, or complete, that any particular lookup will return results, or that any lead will result in business. The Service is provided “as is” and “as available,” without warranties of any kind, express or implied.
8. Fees and plans
Current plan features and limits are described on our pricing page. We may change plans, limits, or pricing prospectively; material changes will be communicated. Amounts paid are non-refundable except where required by law.
9. Intellectual property
The Service, including its software, design, and documentation, belongs to Threshmoor or its licensors. Underlying public records remain public; these Terms do not grant you ownership of the Service itself.
10. Suspension and termination
We may suspend or terminate accounts that violate these Terms, abuse the Service, or create legal risk. You may stop using the Service and close your account at any time.
11. Limitation of liability
To the maximum extent permitted by law, Threshmoor will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to the Service — including any use you make of Contact Data. To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the amounts you paid us in the twelve (12) months before the claim arose.
12. Indemnification
You agree to indemnify and hold Threshmoor harmless from claims arising out of your use of the Service, including your outreach to any contact and your violation of communications or privacy laws.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date, and material changes may require re-acceptance. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules.
